KETUA DPR RI Bambang Soesatyo mengatakan institusinya akan menyiasati upaya pemanggilan pihak-pihak yang perlu dimintai keterangannya dalam mekanisme pengawasan pascaputusan Mahkamah Konstitusi (MK).
MK mengabulkan sebagian permohonan uji materi UU nomor 2 tahun 2018 tentang MPR, DPR, DPD, dan DPRD (UU MD3) terkait dengan pemanggilan paksa dan penyanderaan oleh DPR melalui Mahkamah Kehormatan Dewan (MKD).
“Kami akan berpikir bagaimana menyiasati manakala ada para pihak termasuk pemerintah yang diundang DPR untuk dimintai keterangan namun berkali-kali tidak hadir, dan tentu kami tidak bisa lagi memanggil paksa,” kata Bambang di Kompleks Parlemen, Jakarta, Jumat.
Menurut dia, harus ada cara-cara yang lebih elegan agar keinginan rakyat untuk meminta penjelasan kepada pemerintah melalui DPR bisa dilaksanakan.
Dia mengatakan menyiasati hal tersebut bisa saja pemanggilan para menteri melalui Presiden dan Wakil Presiden agar hadir ketika dipanggil DPR dan tidak mangkir.
“Karena ada beberapa kasus dalam pembahasan UU maupun dalam pengawasan, para menteri dan pejabat negara sulit dihadirkan. Misalnya dalam UU Karantina Kesehatan, sampai sekarang kami belum berhasil hadirkan Dirjen karena berbagai alasan,” ujarnya.
Bambang mengatakan pascaputusan MK itu DPR tidak lagi memiliki alat paksa untuk memanggil pihak-pihak dalam rangka pengawasan sehingga lembaganya harus melobi menteri hingga presiden.
Namun, Bambang menegaskan DPR akan menjalankan putusan Mahkamah Konstitusi yang mengabulkan sebagian permohonan uji materi UU nomor 2 tahun 2018 tentang MPR, DPR, DPD, dan DPRD (UU MD3) terkait dengan pemanggilan paksa dan penyanderaan oleh DPR melalui MKD.
“Bagi DPR sesuai komitmen dari awal, apapun keputusan MK pasti akan kami hormati dan laksanakan,” katanya.
Hal itu, menurut dia, ketika ada UU yang dibahas oleh pemerintah dan DPR ada yang tidak sesuai, maka lembaga yang mengoreksinya adalah MK.
Sebelumnya, MK mengabulkan sebagian permohonan uji materi UU nomor 2 tahun 2018 tentang MPR, DPR, DPD, dan DPRD (UU MD3) terkait dengan pemanggilan paksa dan penyanderaan oleh DPR melalui MKD, dan menyatakan sebagian ketentuan tersebut adalah inkonstitusional.
“Amar putusan menyatakan, mengabulkan permohonan para pemohon untuk sebagian,” ujar Ketua Majelis Hakim Konstitusi Anwar Usman ketika membacakan amar putusan Mahkamah di Gedung MK Jakarta, Kamis (28/6).
Pasal-pasal yang diuji adalah Pasal 73 ayat (3), Pasal 73 ayat (4) huruf a dan c, Pasal 122 huruf k, dan Pasal 245 ayat (1) UU MD3.
Dalam pertimbangan Mahkamah yang dibacakan oleh Hakim Konstitusi Saldi Isra, Mahkamah menyatakan bahwa pemanggilan paksa hanya dapat digunakan untuk penyidikan dalam ranah penegakan hukum dan bukannya dalam rapat anggota dewan.(mediaindonesia.com)
