Partai Republik Gugat Bawaslu dan KPU ke PTUN Jakarta Timur

JAKARTA – Wakil Ketua Umum Partai Republik, Hamdan Patuan Harahap mengatakan pihaknya hari ini menggugat Bawaslu ke Pengadilan Tata Usaha Negara (PTUN). Upaya ini dilakukan setelah Bawaslu menolak gugatan partainya ditolak dalam sidang adjudikasi penyelesaian sengketa proses pemilu di kantor Bawaslu, Jl MH Thamrin, Jakarta Pusat, Rabu (28/3/2018).

Ia menilai keputusan Bawaslu dan KPU yang menolak gugatan partainya tidak objektif. “Fakta Hukum komisioner KPU dan Bawaslu menghianati amanah reformasi. Mereka di samping penghianat juga telah melakukan kejahatan demokrasi,” ujar Hamdan di depan kantor PTUN Jakarta Timur.

Dia menelaskan, kejahatan demokrasi dimulai adanya rapat Kominioner KPU dan Bawaslu pada tanggal 18 Oktober 2017 malam minggu (larut malam). Hasil rapat, intinya pengaturan strategi untuk menghabisi parpol tertentu agar tidak dapat menjadi peserta Pemilu 2019.

“Kami mempunyai rekaman sebagai bukti berupa handphone yang dapat diperdengarkan kepada publik, apabila suatu saat nanti diperlukan,” tegasnya.

Skenarionya, lanjut dia, mulailah KPU memanfaatkan PKPU no 11 thn 2017 sebagai alat kejahatan. Korban kejahatan mereka antara lain Partai Republik. Seharusnya Partai Republik adalah sala satu partai yang diverfikasi faktual, karena telah lolos penelitian administrasi dan mendapatkan tanda terima berdasarkan pasal 27 ayat 6 berupa TT.HP.KPU.PARPOL. Namun bagi KPU bukti itu bukan dasar lolos penelitian, sengaja KPU menerapkan pasal 28, tapi anehnya KPU melanggar Pasal 29 dan 30, selanjutnya mengeluarkan berita acara hasil penelitian.

“Bawaslu yang seharusnya pengawas KPU, demi kejahatan demokrasi melegalkan perbuatan KPU. Bahkan demi terwujudnya kejahatan demokrasi, Bawaslu pun melakukan persidangan-persidangan yang hasil keputusannya bukan objek tata usaha negara.

Dampaknya, kata dia, ada 15 Parpol Peserta Pemilu yang ditetapkan cacat hukum karena faktanya salah satu parpol di sana proses pendaftaran. Verifikasi penelitiannya, telah melanggar TAHAPAN , PROGRAM JADWAL PENYELENGGARAAN PEMILU 2019 yang menjadi bagian yang tidak terpisahkan dengan PKPU no 11 tahun 2017. Oleh karena itu pemilu atau setidaknya jadwal pelaksanaan pemilu terancam batal.

Partai Republik telah mengadakan gugatan hukum ke PTUN Jakarta. “Kami yakin hakim PTUN akan bertindak seadil-adilnya, karena alat bukti kam iadalah fakta hukum produk PTUN itu sendiri,” pungkasnya. (Zul)
