JAKARTA – MAHKAMAH Konstitusi menepis bahwa putusan terhadap perkara Nomor 36/PUU-XV/2017 terkait uji materi Pasal 79 ayat (3) Undang-Undang tentang MPR, DPR, DPRD, dan DPD (MD3) inkonsisten dengan putusan sebelumnya.

Hal itu ditegaskan juru bicara Mahkamah Konstitusi Fajar Laksono saat menanggapi pendapat yang berkembang di masyarakat. Putusan MK sebelumnya yang dimaksud antara lain putusan No 012-016-019/PUU-IV/2006 pada 19 Desember 2006, putusan No 5/PUU-IX/2011 pada 20 Juni 2011 dan putusan No 49/PUU-XI/2013 pada 14 November 2013.

“Penting ditegaskan bahwa dalam putusan-putusan terdahulu, Mahkamah tidak pernah berpendapat yang pada pokoknya menyatakan KPK merupakan lembaga negara yang berada pada ranah kekuasaan tertentu, apakah itu legislatif, eksekutif atau yudikatif,” tegas Fajar dalam konferensi pers, di Gedung Mahkamah Konstitusi, Jakarta, Kamis (15/2).

Menurut Fajar, MK baru berpendapat bahwa KPK merupakan lembaga negara yang berada di ranah kekuasaan eksekutif pada putusan No 36/PUU-XV/2017. Dalam ketiga putusan sebelumnya, Mahkamah hanya menyatakan KPK merupakan lembaga negara yang terkait atau melaksanakan sebagian fungsi kekuasaan kehakiman.

Pada kesempatan itu, Fajar pun menegaskan putusan Mahkamah bukan untuk melemahkan KPK. Di satu sisi, memang Mahkamah menyatakan bahwa hak angket merupakan hak DPR untuk melakukan fungsi pengawasan terhadap KPK.

Di sisi lain, meskipun KPK menjadi objek hak angket DPR, hak angket itu tidak ditujukan kepada kewenangan yudisial KPK, yakni penyelidikan, penyidikan dan penuntutan. DPR bisa melakukan hak angket misalnya terhadap manajemen penanganan perkara, tata kelola sumber daya manusia, dan prosedur standar operasional penyadapan.

Kamis (8/2), MK memutuskan menolak permohonan uji materi UU MD3 terkait dengan hak angket DPR kepada KPK. Dalam pertimbangan MK, KPK merupakan bagian dari ranah eksekutif mengingat tugas dan fungsi KPK yang berada dalam domain eksekutif.

Pakar hukum tata negara dari Universitas Udayana membenarkan bahwa putusan MK tidak membuat penyelidikan, penyidikan, dan penggugatan oleh KPK bisa diangketkan. DPR diingatkannya jangan sampai keliru dalam hal itu,

“Bila DPR mau meributkan persoalan bagaimana pengangkat­an PNS di KPK itu silakan karena itu ranah eksekutif. Namun, kalau sudah masuk di wilayah persoalan peradilan, itu sudah tidak boleh,” tegas Jimny.(Lutfi/Mi).
